Potential Problems

Went to my Friendly Local Gun Shop (FLGS) to pick up some pieces/parts. While I was there, he received a call from a guy bidding on an AR-15 on one of the online auction sites. Since this guy was from Kali, the FLGS was getting together all the bureaucratic requirements in order to ship something there. I looked at the gun in question and stated that there was no way it was legal under the CA AWB (flash supressor, collapsable stock, pistol grip, etc). He replied that he thought so too but that the CA DOJ, when he contacted them, hadn't made any issues about anything but the magazine release which would be modified at the CA shop.

So he called the shop through which the sale would be going through. They stated that no, the gun in its current configuration wasn't CA legal and several pieces would need to be removed or changed in order for it to be legally shipped/sold there.

So what is up w/ the CA DOJ? Do they not know their own requirements?

Is the dealer incorrect in his statements?

Is the potential buyer just not aware of CA laws? Is he trying to get away w/ having a CA banned firearm by going through an outside dealer? Is he a plant?

What I do know is that this is going to cause headaches for all involved.

Update: D from Calguns says it would be legal w/ the modified magazine.

Greetins from the Peoples Republic of Kalifornia. The rifle in questions can most likely be configured in a California legal configuration. This pdf should clarify some of the crazy laws we have here in CA. http://www.calguns.net/caawid/flowchart.pdf
Depending on the lower receiver of the AR in question, it can most likely be made CA legal by installing what is known as a "Bullet Button" which replaces the magazine release button, and only allows the magazine to be removed with a tool. This classifies the weapon as a semi-auto with a fixed magazine which can have all the "evil" features. i.e. pistol grip, adjustable stock, etc. If you have any other questions email me, or check out CalGuns.net

I think we can look for a lot more of this type of BS under the watchful eye and benevolent reign of Eric Holder...

Word to the wise: Do NOT sell any firearm to ANYONE in California under ANY circumstances (unless you live there).

California, New York, New Jersey, Maryland, Washington and others have plants all over the country.

This is much bigger than the average small dealer understands. One of the approaches is to destroy all online sales of firearms (and of course gun shows).

The ATF is well aware of the tactic as well. Stick to what you know and do NOT be tempted by online buyers who have special needs or live in a socialist state.

Avoid this at all costs.

Really "Anonymous"? "Do not sell ANY firearm to ANYONE in CA"? What you don't realize is that CA has one of the largest legal firearms markets in the US. Stop spreading FUD. Since 2005, we've been able to legally bring in over a 100K lower receivers into CA. When CA DOJ tried to illegally ban AR/AK style rifles in 2006, the citizens of CA bought out AR lowers in the ENTIRE NATION in 2 weeks. Now THAT's market share. CA has some of the most restrictive firearms laws in the nation however we have fought very hard for some of the few rights we have and we're not giving them up.
Refusing to sell to CA is trying punish the citizens of CA just because you don't like their oppressive laws. But the fact of the matter is that the only thing you're hurting is your own sales. CA ARs are legal and here to stay. :)
Oh BTW. Do you have any evidence of CA DOJ having "plants" all over the country? Link?
You don't because it's BS.
Read up on your facts before you marginalize an entire segment of RKBA citizens.

My understanding of the law (IANAL)from reading Calguns.net is that a licensed dealer can send anything to a licensed California dealer, whether or not it complies with California law. It is up to the California dealer to determine legality and make any required modifications before it gets to the end customer.

As another CalGunner, I'm glad to see that D is helping to dispel all the FUD coming from non-residents.

The law is that any firearm that is classified as an "Assault Weapon" (read the chart) cannot be handled by a CA FFL *unless* he has a CA AW Dealer Permit. This means that on Off-List firearms, they must have the "evil features" removed before they come into the state.

Maybe Cal needs to be returned to Mexico, we'd ALL be better off I think...

Since the fault refuses to break it off so it floats off to sea, just let Mexico have it back.

Just make sure Pelosi is a home when it occurs so we get rid of her communist arse too!

Some good comments here. Remember that Ca isn't all privileged assholes trying to subvert our country. There's a significant segment of the Ca population that very much wants to turn the state around. Must of them don't live in the "famous cultural centers" but are rural folks just looking to get by. Cutting those folks off is cutting our own throats. If gun bans succeed in ANY state another will fall right behind it and another and another until yours is up on the block. Support our brothers on the left coast and avoid marginalization of folks that are 100% behind the rest of us.
